A aucun moment, la Mauritius Union Assurance n’a laissé entendre qu’elle «va honorer ses engagements après la plainte en réclamation des administrateurs» de la BAI. L’express tient à s’excuser pour cette interprétation erronée, mais sans mauvaise foi de sa part, et publie ci-dessous la mise au point de la Mauritius Union Assurance.

Further to the article which appeared in lexpress.mu, Infobusiness of 05th November 2015, we would like to draw your attention to the fact that it contains a gross inaccuracy.

We quote your title: “MUA paiera pour les fautes des directeurs de la BAI, mais… » and its related article which reads : “La Mauritius Union Assurance, qui a offert une couverture “Directors and Officers Liability” à la BAI, va honorer ses engagements après la plainte en réclamation des administrateurs. Toutefois, le match se jouera sur le montant du dédommagement. »

This article as it stands constitutes an enormous prejudice to Mauritius Union as it is likely to make your readers believe that the settlements of these claims are payable automatically under the policies referred to in your article.

Nothing could be further from the truth as our official communiqué published in l’express daily edition dated 04th November 2015.In short, the position is as follows:

Mauritius Union is in presence of a Plaint With Summons

Mauritius Union is proceeding under a full reservation of its rights under and in relation to the policies named in the Plaint.

The policies subject matter of the Plaint are fully reinsured

Reinsurers are proceeding under a full reservation of their rights under and in relation to the reinsurance policies.

Management assisted by its reinsurers is working with its legal team in determining its response to the Plaint in accordance with, amongst other things, the terms and conditions of each policy.

Nowhere is it mentioned that MUA and/or its reinsurers will pay outright any sum almost automatically; but that each claim will receive our professional and detailed analysis and attention according to the terms and conditions of each policy.

Mauritius Union, being a listed company, you will appreciate that such statements are extremely damaging, prejudicial and could entail considerable consequential damages to its shareholders, its customers and the public in general.
