La bataille juridique entre MTC Sports & Leisure Ltd (MTCSL)/Mauritius Turf Club (MTC) et People’s Turf PLC (PTP PLC) concernant l’empiètement allégué de propriété par les premiers nommés à la Rue Eugène Laurent, en face du bâtiment MTCSL/MTC, a livré un premier résultat, hier, vendredi le 28 octobre.

La cour a, en effet, accordé la demande d’injonction présentée conjointement par MTC Sports & Leisure Limited (MTCSL) et sa subsidiaire MTC, contre People’s Turf PLC (PTP PLC), en attendant que l’affaire principale (Main case) soit entendue. 

MTCSL et MTC avaient demandé que PTP PLC soit sommée de ne plus empiéter sur leur propriété avec l’installation d’une immense structure pour permettre aux officiels et aux journalistes d’assister aux courses lors des journées organisées par ce même organisateur. Avec le jugement rendu hier, PTP PLC ne pourra pas ériger de structure juste devant le bâtiment MTCSL/ MTC (voir ci-dessous l’ordre émis par la magistrate Johan Moutou-Leckning.)

Il est bon de préciser que cette injonction obtenue ne concerne pas une structure qui serait mise en place pour les besoins de la photo finish. PTP PLC pourra toujours en installer une rien que pour prendre les photos finish. 

L’ordre émis par la magistrate Johan Moutou-Leckning se lit comme suit : 

(i) Preventing and restraining the respondent from encroaching and/or trespassing onto the property of the MTC, including by pressing its structures onto the MTC walls and floor in the setback area underneath the roof bordering Eugene Laurent Street; 

(ii) Preventing and restraining the respondent from doing any act which would prevent MTC and/or its tenant MTCSL from walking freely within the property of MTC or otherwise using such property, including in the set-back area underneath the roof bordering Eugene Laurent Street; 

(iii) Preventing and restraining the respondent from erecting any structure whatsoever (other than the smaller structure erected for the photo finish of the respondent) in front of and/or adjacent to the building of the MTC including the MTC Loges and the MTCSL Loges, which would in any way block the view of those present in these premises when watching horse races at the Champ de Mars organized by the respondent, or which would otherwise prevent the MTC and/or its tenant, MTCSL, from having the quiet and peaceful enjoyment of these properties; 

(iv) Pulling down any structure erected or removing any object installed, in contravention of orders (i)-(iii) above.
